Reporting a sale of more than one pistol or revolver
This is the reporting duty most easily missed, because nothing has gone wrong when it arises. A licensee must prepare a report whenever they sell or otherwise dispose of, AT ONE TIME OR DURING ANY FIVE CONSECUTIVE BUSINESS DAYS, two or more pistols, or revolvers, or any combination of pistols and revolvers totaling two or more, to an unlicensed person. The five-day window is what makes it easy to miss: two entirely ordinary sales, days apart, to a returning customer, become a reportable event without either transaction being unusual in itself. One exclusion applies — no report is needed where pistols or revolvers are returned to the same person they were received from.
The report goes on Form 3310.4, and the deadline is the tightest of the three in this chapter. Not later than the CLOSE OF BUSINESS on the day the multiple sale or other disposition occurs, the licensee forwards two copies to the ATF office specified on the form and one copy to the State police or the local law enforcement agency for the place where the sale occurred. Where State or local officials have notified the licensee that a particular official is designated to receive Forms 3310.4, the forms go to that official instead. The licensee keeps one copy and attaches it to the Form 4473 executed on delivery — so the report and the transaction record end up filed together.
The regulation gives two worked examples, and the second is the one worth memorizing. A pistol and a revolver sold in a single transaction to an unlicensed person is a multiple sale, reportable by close of business that day. A pistol sold on Monday and a revolver sold on the following Friday to the same unlicensed person is also a multiple sale, reportable by close of business on the Friday. And if that same person buys another pistol or revolver on the following Monday, that is an ADDITIONAL multiple sale and must also be reported. The window does not reset at one report; each qualifying combination is its own reportable event.
