Tracing requests

Everything in this chapter exists so that a firearm can be followed by someone who was not there when it was sold, and this is the provision that makes that concrete. Each licensee shall respond IMMEDIATELY to, and in no event later than 24 hours after receipt of, a request by an ATF officer at the National Tracing Center for information in the records this part requires — where the request is for determining the disposition of one or more firearms in the course of a bona fide criminal investigation. Immediately is the standard; 24 hours is the outer limit, not the allowance.

The manner is specified as well as the timing. The requested information shall be provided ORALLY to the ATF officer within the 24-hour period. That is unusual in a regime built on written records, and it tells you what the provision is for: someone is working a live investigation and needs an answer now, not a document later. The regulation also anticipates the obvious worry about giving customer information to a caller. Verification of the identity and employment of National Tracing Center personnel requesting information may be established at the time the information is provided, by telephoning the toll-free number 1-800-788-7132 or using the toll-free facsimile number 1-800-788-7133.

A separate and slower obligation covers periodic reporting. When required by letter from the Director of Industry Operations, and until notified to the contrary in writing, a licensee submits all record information required by this subpart on Form 5300.5, Report of Firearms Transactions, for the periods and at the times the letter specifies — or such lesser information as the letter may specify. A licensee who needs a different arrangement may apply: where an alternate method of reporting is reasonably necessary and will not unduly hinder the effective administration of this part, the Director of Industry Operations may authorize it on a letter application submitted in duplicate describing the proposed method and the need for it. The alternate method may not be used until it has been approved.

The bound record holds every receipt and disposition, and it begins with the inventory already on the shelf rather than with the first sale.
