One sentence in 28 TAC § 34.616 settles an argument that used to be decided by whoever held the laptop. ON REQUEST OF THE OWNER of the fire alarm system, a registered firm MUST PROVIDE ALL PASSWORDS, INCLUDING THOSE FOR THE SITE-SPECIFIC SOFTWARE. Read the scope of that. It is all passwords, not the ones the firm considers appropriate. It expressly includes the site-specific software, which is the layer that actually determines how a particular building’s system behaves, and the layer a departing firm has the most commercial reason to keep. And the trigger is a request by the owner — not a change of contractor, not the end of a contract, not a dispute.

The rule then gives the firm one lever and only one. The registered firm MAY REFRAIN FROM PROVIDING THAT INFORMATION UNTIL THE SYSTEM OWNER SIGNS A LIABILITY WAIVER PROVIDED BY THE REGISTERED FIRM. That is a delay condition, not a refusal right: the waiver is the firm’s to draft and to provide, and once it is signed the passwords are owed. A firm that has no waiver ready has no ground to wait on, and a firm that treats the waiver as a negotiation has misread which side of the sentence it is standing on.

The provision matters beyond its own paragraph because of what the rest of this book has established about who answers for a system. A licensee acts under a particular firm’s certificate of registration number, from Chapter 3. Record drawings go to the owner and the installation certificate is presented to them or posted near the panel, from Chapter 8. Every label carries the firm’s identity, from Chapter 9. This rule completes the pattern. The paperwork, the drawings, the labels and now the access all end up with the property owner, because the obligations in this subchapter attach to the system rather than to the commercial relationship around it. A system that cannot be handed to the next firm is a system the current firm has made harder to keep in service, which is the opposite of what the chapter exists for.
