Going out of business

Chapter 8 answered how long each record must be kept while a business is running. This is the other end of that question, and it is the last compliance act this book describes: what becomes of the records when the business stops. The answer turns on a single distinction — whether the business is SUCCEEDED or whether the discontinuance is ABSOLUTE — and the two paths send the records to different places.

Where a licensed business is discontinued and succeeded by a new licensee, the records prescribed by the recordkeeping subpart must appropriately reflect those facts and must be DELIVERED TO THE SUCCESSOR. The records follow the business. Alternatively, in that same succession case, they may instead be delivered within 30 days following the discontinuance to the ATF Out-of-Business Records Center or to any ATF office in the division in which the business was located — so succession offers a choice that absolute discontinuance does not.

Where the discontinuance is absolute, there is no choice. The records must be delivered WITHIN 30 DAYS following the business discontinuance to the ATF Out-of-Business Records Center at 244 Needy Road, Martinsburg, West Virginia 25405, or to any ATF office in the division in which the business was located. One qualification sits alongside it: where state law or local ordinance requires delivery of records to another responsible authority, the Chief, Federal Firearms Licensing Center may arrange for the records to go to that authority instead.

It is worth seeing how this obligation connects to a rule from earlier in the book that otherwise looks arbitrary. A licensee retains each Form 4473 UNTIL BUSINESS OR LICENSED ACTIVITY IS DISCONTINUED — there is no expiry date on it. Set that beside the tracing duty Chapter 8 covers, where a licensee must answer a trace request about a firearm they once transferred, and a reader can draw the connection for themselves: a record that can locate the person who received a firearm is only useful for as long as it exists, and the 30-day delivery is what keeps it in reach after the business that created it is gone.
