Renewal is a deadline rather than a reminder. A licensee who intends to continue the business or activity described on the license during any portion of the ensuing year must, unless notified otherwise in writing by the Chief of the Federal Firearms Licensing Center, execute and file ATF Form 8 Part II with the required fee before the license expires. The Chief may also require a renewal applicant to file a completed Form 7 or Form 7CR in the manner § 478.44 sets out — so renewal is not guaranteed to be the short path, and being asked for the longer one is not a sign that something is wrong.

Missing the deadline costs more than a late fee, because there is no late lane. If a licensee does not timely file Form 8 Part II, they must file Form 7 or Form 7CR as an original applicant and obtain the license before continuing — the whole eligibility and issuance sequence in this chapter, run again from the start. That is the concrete reason § 2.3 called continuity of renewal worth protecting: it is not only the license number that rides on it. An applicant who is an alien admitted under a nonimmigrant visa must also include documentation showing they fall within an exception in 18 U.S.C. 922(y)(2), such as a hunting license lawfully issued in the United States, or that they have obtained a waiver under 18 U.S.C. 922(y)(3).

One provision keeps a business trading while its paperwork is contested, and the condition attached to it is the reason timely filing matters twice over. Where denial, suspension, or revocation proceedings are pending, a license already in the licensee’s possession can remain in effect even though it has expired — but for an expired license that protection applies only if the licensee timely filed the renewal application. Filing on time therefore does two jobs: it keeps the ordinary renewal simple, and it is the precondition for continuing to operate while a dispute is resolved. Chapter 4 takes up operating while proceedings are pending, and the review that follows a final decision.
